These Terms & Conditions ("Terms") govern your access to and use of the Haper mobile application, website at haper.in, and all related services (collectively, the "Services") operated by Hapverse Private Limited ("Haper", "we", "us", or "our").
By creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
The Services are intended for users who are at least 18 years old and capable of entering into a legally binding contract under Indian law. By using the Services, you represent and warrant that you meet these requirements.
2. Your account
- You are responsible for maintaining the confidentiality of your account and the device on which the Haper app is installed.
- You agree to provide accurate, current and complete information at sign-up and to keep it updated.
- You are responsible for all activity that occurs under your account.
- We may suspend or terminate accounts that violate these Terms, engage in fraud, or misuse the Services.
3. Products & pricing
- Product availability, prices and applicable fees are displayed in the app and may change at any time without notice.
- Product images are for reference only; actual products may vary slightly in packaging or appearance.
- Weights and quantities are approximate; some natural variation may occur for fresh produce.
- All prices are in Indian Rupees (₹) and inclusive of applicable taxes unless stated otherwise.
- Introductory or promotional pricing (including free delivery, ₹0 packaging) is subject to change without notice.
4. Orders & acceptance
Placing an order constitutes an offer to purchase. Your order is accepted only when we send a confirmation. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, unavailability, or breach of these Terms.
5. Cancellations, refunds & returns
Cancellations, refunds and returns are governed by our Cancellation & Refund Policy, which is incorporated by reference into these Terms.
6. Delivery
Delivery is governed by our Shipping & Delivery Policy. We strive to deliver as fast as possible but do not commit to a specific delivery time. Delivery is subject to serviceability of your pin code, product availability and operational conditions.
7. Payments
- We accept payments via UPI, debit/credit cards and net banking, processed by our payment gateway partner Razorpay.
- Cash on Delivery (COD) is available for orders placed in select pin codes, at our sole discretion.
- You authorise us to collect the order amount via your chosen payment method.
- We do not store your card or banking credentials on our servers.
8. Wallet & credits
- The Haper wallet is a non-refundable, non-withdrawable store credit balance held in your account.
- Wallet credits do not expire and may be used to pay for future orders.
- Wallet credits cannot be transferred, exchanged for cash, or remitted to a bank account.
- Wallet credits may be revoked in cases of fraud, abuse, or violation of these Terms.
9. Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent or harmful purpose.
- Place orders with the intent of refusing delivery, claiming false refunds, or otherwise gaming the platform.
- Reverse-engineer, decompile, scrape or interfere with the Services.
- Impersonate any person, harass riders or staff, or upload abusive content.
- Violate any applicable Indian law, including consumer-protection, tax and IT laws.
10. Intellectual property
All content on the Services — including the Haper name, logo, designs, text, graphics and software — is owned by or licensed to Hapverse Private Limited and protected by intellectual property laws. You may not copy, modify or distribute our content without written permission.
11. Third-party services
The Services rely on third parties such as Razorpay (payments), Firebase (notifications, analytics, crash reporting), and SMS / email gateways. Your use of those features is also subject to the respective providers' terms.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant uninterrupted or error-free operation, or that all products will meet your expectations.
13. Limitation of liability
To the maximum extent permitted by law, our total liability arising from or relating to the Services shall not exceed the value of the order giving rise to the claim, or ₹5,000, whichever is higher. We are not liable for indirect, incidental or consequential damages.
14. Indemnity
You agree to indemnify and hold harmless Hapverse Private Limited, its directors, employees and partners from any claims, losses or expenses arising from your breach of these Terms or your misuse of the Services.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the app or website. Your continued use of the Services after such changes constitutes acceptance.
16. Governing law & jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka.
